ORDER When the Writ Petition is taken up for hearing, the learned Senior Counsel appearing for the respondent submitted that the respondent-Board has paid the difference in pay/pension to all the petitioners herein except the 5th petitioner herein. https://www.mhc.tn.gov.in/judis

2. The learned Senior Counsel further submitted that, insofar as the 5th petitioner is concerned, the respondent-Board is willing to pay the difference of pay/pension. However, since the 5th petitioner had deceased, the legal heirs of the deceased 5th petitioner are required to approach the concerned authority to claim the said amount along with the legal heir certificate and other relevant documents, upon which the respondent would disburse the said amount.
3. The learned Senior Counsel also submitted that if the legal heirs of the 5th petitioner approach the respondent authority, they shall pay the difference of pay/pension in accordance with law.
4. In response, the learned counsel for the petitioners requested this Court to record the aforesaid submissions made by the learned Senior Counsel for the respondent with regard to the respondent’s willingness to pay the difference of pay and difference in pension to the legal heirs of the deceased 5th petitioner.
5. Accordingly, the submission made by the learned Senior Counsel on behalf of the respondent is taken on record. https://www.mhc.tn.gov.in/judis

6. Further, taking note of the fact that the respondent has already paid the difference of pay and difference in pension to all the petitioners except the 5th petitioner and having expressed its willingness to pay the difference of pay/pension to the legal heirs of the deceased 5th petitioner upon submission of the necessary documents, this Court is of the view that nothing further survives for further consideration in this Writ Petition.
