No.7364/Vai Ni 4/TNSTC/CBE/Erode Region/12 issued by the 2nd respondent, showing a sum of Rs.3,22,632/- towards CSR recovery and insisting the petitioner to clear and remit the said CSR recovery amount as a condition for sanctioning pensionary benefits, quash the same and consequently direct the respondents to pay the petitioners forthwith the commuted value of pension and other terminal benefits and monthly pension with effect from 1.2.2011 with arrears and other consequential benefits including the revision and increase in https://www.mhc.tn.gov.in/judis WP Nos.39211 & 39212 of 2015 __________ Page3 of 6 pension, together with interest at the rate of 12% per annum, award costs WP No. 39212 of 2015 Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the check slip for settlement of Account No.000321 issued by the 2nd respondent, showing a sum of Rs.2,98,331/- towards CSR recovery and insisting the petitioner to clear and remit the said CSR recovery amount as a condition for sanctioning pensionary benefits, quash the same and consequently direct the respondents to pay the petitioner forthwith the difference in salary from 1.3.2008 to 30.4.2013, Provident Fund, Gratuity, Earned Leave Salary, Family Welfare Fund, IRT Contribution etc., the commuted value of pension and monthly pension with effect from 1.5.2013 based on the actual pay payable to the petitioner as on the date of his superannuation with arrears and other consequential benefits including the revision and increase in pension, together with interest at the rate of 12% per annum, award costs. She further submits that the recovered amount has been duly settled and that the matter has consequently become infructuous. She therefore seeks leave of this Court to withdraw the present Writ Petitions. She has also made an endorsement to that effect in the court bundle. 2.Recording the submissions and endorsement made by Ms.H.Nandhini, learned counsel, the present Writ Petitions are dismissed as withdrawn. Consequently, connected Miscellaneous Petition is also closed.
