Heard. 2. By way of this petition, the petitioner seeks the following reliefs : 10.1 That, the Hon'ble court may kindly be pleased to call for entire records pertaining to the case of petitioner, in the interest of justice. 10.2 That, the Hon'ble court may kindly be pleased to issue an appropriate writ directing to the respondents to consider and decide the petitioner's representation. 10.3 Any other relief which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case to the petitioner. 3. Learned counsel for the petitioner submits that the husband of the petitioner was working as an Assistant Teacher (LB) at the Primary School, Bagbuda Block Tamnar. He further submits that though other service benefits with regard to the petitioner’s late hsuband have been disbursed to the petitioner, but the benefits under the Group Insurance Scheme (GIS) have not yet been provided to the family members of the deceased-employee. He submits that the deceased-employee could not submit the requisite application during his lifetime before the concerned BEO, 3 therefore, the above claim remained unconsidered. Furthermore, while the GIS proceedings were being finalised for other similarly situated persons, the petitioner’s husband expired. In view of the above, the petitioner prays to dispose of this Petition with liberty to the petitioner to file a fresh representation before the Block Education Officer, Tamnar, District Raigarh in this regard. He further prays for a direction to the concerned BEO to consider the claim of the petitioner in accordance with law, taking into account the untimely death of her husband and the fact that the petitioner is in dire financial need. 4. The submissions advanced by learned counsel for the petitioner appears to be fair and reasonable. 5. Considering the facts and circumstances of the case, the petitioner is directed to file a fresh application along with the relevant documents before the Block Education Officer, Tamnar District Raigarh, and in turn, the concerned BEO is directed to consider the claim of the petitioner in accordance with law, keeping in mind that the petitioner’s husband expired prematurely and was unable to submit the requisite Application/Form during his lifetime. The concerned authority shall further take into account that the petitioner is a widow in need of the aforementioned benefits to which she would have otherwise been entitled had the application been submitted in due time. 6. Without entering into the merits of the case, the Writ Petition is disposed of with liberty to the petitioner to file a fresh application with regard to GIS before the concerned BEO. Upon receipt of 4 such application, the concerned BEO is directed to consider the application of the petitioner in this regard and pass a reasoned order in accordance with law. The application shall be filed by the petitioner within a period of 20 days of the receipt of a copy of this order; thereafter, the concerned authorities are directed to consider/decide the same within a further period of 45 days. 7.
