An affidavit dated 05.01.2026 has been filed on behalf of respondent no.1 in compliance with the order dated 10.12.2025 passed in the present proceedings. 2. A perusal of the said affidavit reveals that a fresh/modified Policy has been issued/adopted by the respondent no.1/Land & Development Office (L&DO). In this regard, it has been specifically averred in paragraph nos. 5 and 6 of the said affidavit as under: “5. That further the revised procedure under the modified policy is as follow: As per Clause 2.5 of the Office Memorandum dated 23.07.2024: (i) In cases where Relinquishment Deed/ Will/Gift Deed etc. is involved: “The Sections will send a letter to all the legal heirs, prospective interest holders/stakeholders, etc. of the property intimating that the application of substitution/mutation is under process in L&DO on the basis of Relinquishment Deed/Will/Gift Deed/NOC. Etc. and case, the legal heirs, prospective interest holders/ stakeholders have objection, if any, they are This is a digitally signed order. That this affidavit is being filed to place the revised policy of L&DO on record and to clarify the current Government procedure for substitution/mutation based on Will/Relinquishment Deed/ Gift Deed.” 3. In light of the aforesaid, the challenge made in the present petition to the provision/s contained in the unamended (previous) policy of respondent no.1 (previous policy), does not survive. 4. The present petition is, accordingly, disposed of, taking on record the extant policy as disclosed in the aforesaid affidavit filed on behalf of the respondent no.1/L&DO. 5. Needless to say, the petitioner’s application for substitution/mutation of the concerned property be dealt with in terms of the revised/extant policy.
