This application has been filed on behalf of the appellant seeking condonation of delay of three (3) days in filing the undertaking, as directed in terms of the order passed by this Court on 17th April, 2026. 2. For the reasons stated in the application and taking into account the period of delay, the delay is condoned. 3. The application stands disposed of. RFA 759/2015 4. After hearing the counsel for the parties, this Court, by order dated 17th April 2026, had noted the broad terms of settlement arrived at between the parties, which are set out below:- “i. The principal amount, which is the subject matter of the impugned decree, i.e. Rs.10,75,500/-, shall be paid by the appellant to the respondent along with interest at the rate of 8% per annum from the date of filing of the suit. This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 02/05/2026 at 12:27:46 RFA 759/2015 ii. Out of the aforesaid amount, a sum of Rs.6,00,000/- shall be paid by the appellant to the respondent within eight (8) weeks from today. iii. The remaining amount shall be paid in monthly instalments of Rs.75,000/- till the time the entire amount is exhausted.” 5. Counsel for the appellant has filed an undertaking in terms of the aforesaid order. The relevant extracts from the undertaking are reproduced hereinafter:- “4. I undertake to pay the principal amount, which is the subject matter of the impugned decree dated 28.7.2015, i.e. Rs.10,75,500/- to the respondent along with interest at the rate of 8% per annum from the date of filing of the suit. Thus as on 17.4.2026 the total amount payable is Rs.24,01,950/-(Rupees Twenty Four Lakhs One Thousand Nine Hundred Fifty only). 5. I further undertake that out of the aforesaid amount, a sum of Rs.6,00,000/- shall be paid to the respondent within eight (8) weeks from 17.4.2026, I further undertake to pay the remaining amount in monthly instalments of Rs.75,000/- (Rupees Seventy Five Thousand only) till the time the entire amount is exhausted (i.e. 24 months).” 6. The aforesaid undertaking is taken on record and the appellant shall remain bound by the terms of the undertaking. 7. Accordingly, the present appeal is disposed of.
