1. Appellant Insurance Company has filed an appeal for reduction of the award dated 15.05.2015 passed by the Learned MACT, awarding a compensation of Rs. 45,60,000/- along with interest @ 9% p.a. from the date of filing of claim petition.

On appeal, the Insurance Company deposited entire awarded amount with up to date interest in terms of the order dated 03.08.2015 passed by this Hon’ble Court deposited before the Registrar General, Delhi High Court and direction was issued to release 50% of awarded amount in terms of the award of the Tribunal.

Learned Counsel for Insurance Company on instruction have submitted that the name of the appellant i.e. Reliance General Insurance Company has been changed to Indusind General Insurance Company Limited and the Learned counsel for the insurance company has further submitted that NOC has been issued by IRDAI and new certificate of incorporation issued by ROC in favour of IGICL. 4. It is submitted that from now onwards, the name of the appellant shall be read as Indusind General Insurance Company Limited (formerly -Reliance General Insurance Company).
5. After comprehensive discussions, it is agreed between the
learned Counsel for the parties that out of the balance deposited amount along with the accrued interest lying before the Registrar General, lump sum amount Rs. 75,000/- be refunded to Insurance Company and balance amount lying deposited before the Registrar General along with the total interest after deducting Rs. 75,000/- shall be directed to be released to the respondent/claimant(s) as per the proportions detailed in the award of the Tribunal, subject to compliance of all the required formalities.
6. On filing of the copy of certificate of incorporation issued by ROC in favour of IGICL, in the Registry, the statutory amount along with the interest, if any, be refunded to Indusind General Insurance Company Limited on compliance of all the requisite formalities.
7. Accordingly, the present appeal along with the pending applications, if any, is disposed of with directions in term of the settlement.
