DATED : 17th February, 2026 This Court on 29/09/2022 recorded the presence of the petitioner in person and also his statement that the only grievance now remains is with regard to receiving an amount of Rs.2,37,978/- on account of arrears towards his entitlement as per the recommendations of the 6th Pay Commission.
2. Admittedly, the petitioner has received certain amount towards his entitlement as per the recommendations of 6th Pay Commission. The amount received by the petitioner is as per the calculations made by respondent No.3-College which the petitioner is disputing.
3. Thus, the arrears shall be calculated as per the Pay Scale of Rs.16,200/- as claimed by the petitioner or Rs.15,360/- as taken into
consideration for calculation of arrears of the petitioner by the respondent, is the only question.
4. It is difficult for us to adjudicate this issue in writ jurisdiction.
5. Therefore, considering the age of the petitioner and the period 2026:BHC-NAG:3015-DB
2 913-WP-1445-15.odt for which the petition is pending, we are of the opinion that it will in the interest of justice to direct the respondent No.2-Joint Director of Higher Education to make the calculations as per the recommendations of 6th Pay Commission and the Rules/Guidelines in relation to the same.
6. The respondent No.2-Joint Director shall take into
consideration the grounds raised in the petition as well as the reply to the same by the respondent No.3-College whereby the respondent No.3 has tried to justify its calculations.
7. The respondent No.2 shall take decision in that regard within a period of four weeks from the date of appearance of the parties. The petitioner and respondent No.3 through its representative shall attend the office of Joint Director on 27/02/2026 at 11 am.
8. Shri Raghute, learned counsel for the petitioner undertakes to submit copy of this order as well as copy of the petition and reply before respondent No.2 on 27/02/2026.
9. Respondent No.2-Joint Director, Higher Education is directed to communicate the decision to the petitioner as well as respondent No.3-College within two weeks from the date of such decision.
10. Writ petition is disposed of in aforesaid terms. No order as to costs.
