Sharma, Advocate, for the applicants/respondents. CMP No.23382 of 2026 The instant application has been filed for the substitution of the legal heirs of deceased respondent No.4 in a decided matter. It has been contended that respondent No.4 expired on 04.10.2018 during the pendency of this first appeal. The applicants have placed on record the copy of death certificate which shows that respondent No.4 expired on 04.10.2018 and the legal heirs certificate has also been appended as Annexure A-2. In view of the averments made in the application, which is duly supported by an affidavit, the present application is allowed, and the legal heirs of respondent No.4 as mentioned in para 3 of the application are ordered to be substituted as respondent No.4(a) to 4(f), subject to all just exceptions. Learned counsel for the applicants undertakes to file fresh amended memo of parties within a period of ten days from today. Accordingly, the application stands allowed.
