Mr. Khan, learned counsel for the petitioner submits that this criminal
Page No.# 2/2 petition was preferred by the petitioner, aggrieved vide order dated 10.11.2014, whereby, exercising the powers under 319 Cr.P.C, he was summoned as an accused in Special NDPS Case No. 6/2013. Today it is submitted by the learned counsel that in the meantime, the petitioner has expired on 28.01.2026. A copy of the death certificate issued by the Municipal Authority of Delhi is placed before this Court. I perused the same, which indicates the date of death of Vikas Bhardwaj as 28.01.2026 at Delhi. Mr. K. Jain, learned Standing Counsel appearing for Central Excise and Customs submits that he does not dispute the aforesaid contention regarding death of the petitioner and submits that necessary orders can be passed. In the context of the above developments, the instant criminal petition is stated to have become infructuous and is accordingly disposed of. A copy of the death certificate be kept on record and marked as document ‘X’.
