ORDER: (Per Hon’ble Sri Justice D.Ramesh)
1. This Civil Miscellaneous Appeal is filed aggrieved by the
order dated 06.03.2015 passed by the learned XI Additional District and Sessions Judge, Krishna at Gudivada in I.A. No.853 of 2014 in O.S. No.73 of 2014.
2. When the matter is taken up for hearing, the learned counsel for the appellant submits that the main suit itself has already been decreed and, therefore, no further orders are required to be passed in the present appeal.
3. Since the present appeal arises out of an interlocutory
order passed in I.A. No.853 of 2014 and the main suit itself has subsequently been decreed, the cause for pursuing the present appeal no longer survives. Consequently, the appeal has become infructuous.
4. Accordingly, the Civil Miscellaneous Appeal is dismissed as infructuous. There shall be no order as to costs.
