3. 1. This matter is taken up through Hybrid Mode.
2. Heard learned counsel appearing for the parties.
3. It is contended that Petitioner does not intend to press the Writ Petition with the prayer as made. However, it is contended that even though Petitioner was disallowed to continue with the supply of THR Chhatua, but Petitioner is yet to get back some amount as due and admissible for such supply of THR Chhatua, prior to such discontinuance. It is accordingly contended that Opp. Party No.1 be directed to pay the dues of the Petitioner for such supply of THR Chhatua.
4. Learned Addl. Standing Counsel appearing for the State contended that since no such approach was ever made by the Petitioner claiming release of any amount as due and admissible to the Petitioner, the prayer made in that regard is not entertainable.
5. Having heard learned counsel for the parties and considering the submission made, this Court while disposing
the Writ Petition permits the Petitioner to make an appropriate application before Opp. Party No.1 within a period of three (3) weeks hence for release of any amount towards supply of THR Chhatua. 5.1 It is observed that if any such representation is filed within the aforesaid time period, Opp. Party No. 1 shall do well to take a lawful decision on the same within a period of three (3) months from the date of receipt of such representation. The order so passed by Opp. Party No. 1 be communicated to the Petitioner.
6. With the aforesaid observation and direction, the Writ Petition is disposed of.
