1. This matter is taken up through hybrid mode.
2. Heard.
3. The Writ Petition has been filed inter alia with the following prayer.
“In the facts and circumstances of the case, the humble petitioner fervently pray this Hon’ble Court to be graciously pleased to issue notice to the Opp. Parties, call for the relevant records and after hearing the counsel of parties issue a writ in the nature of mandamus commending to the opp. Party to refund the Rs.1,51,252.94 to the petitioner as recovered from the legitimate dues of the petitioner with interest @ 18% from the date of recovery to the date of refund in the interest of justice. And/ or pass such other order or direction as deems fit and proper in the interest of justice. And for this act of kindness the humble petitioner shall as in duty bound ever pray.”

4. Learned counsel for the Petitioner contended that since the amount in question has been illegally recovered from the Petitioner, he may be permitted to move the Opp. Party- Bank for refund of the same.
5. Mr. G.N. Sahu, learned counsel appearing for Opp. Party-Bank has no serious objection to the course of action proposed.
6. Having heard learned counsel appearing for the Parties and considering the submission made, this Court while disposing of the Writ Petition permits the Petitioner to move the Opp. Party-Bank by making an appropriate application for refund of the amount in question so recovered from him.
7. It is observed that if any such application is moved within a period of three (3) weeks hence, Opp. Party shall do well to take a lawful decision on the same within a further period of three (3) months from the date of receipt of such application. The order so passed by Opp. Party be communicated to the Petitioner.
8. The Writ Petition stands disposed of.
