Learned counsel for the respondents has not seriously objected to the Delay Condonation Application. As such, the Delay Condonation Application (CLMA No. 6123 of 2014) is allowed. The delay is hereby condoned. 4. The present appeal from order has been filed by the appellant against the judgment and order dated 17.10.2013 passed by MACT/District Judge, Udham Singh Nagar (Rudrapur), in MACP Case No. 80 of 2010. 5. Learned counsel for the appellant submits that the learned MACT concerned has not taken into consideration the averments made by him in the written statement and have passed the award in an arbitrary and cursory manner. 6. Per contra, learned counsel for the respondents/Insurance Company have submitted that the award passed by MACT concerned is proper and just. 7. Heard learned counsel for the parties and perused the record. 8. As such, the Tribunal concerned in the opinion of this Court have rightly came to the conclusion that the respondent nos. 1 and 2 in the claim petition have nowhere stated that the present revisionist is their employee, therefore, this Court does not find any reason to interfere with the impugned judgment and order dated 17.10.2013 passed by MACT/District Judge, Udham Singh Nagar (Rudrapur), in MACP Case No. 80 of 2010. 9.
