Learned counsel for the petitioner submits that the petitioner had earlier sought the relief for quashing the Advertisement Notice dated 19.07.2012 and also the selection/appointment of respondent No. 5 as ReT Teacher in the Middle School Dallan, Zone Poonch Tehsil Haveli. He further submits that in the interregnum the respondent No. 5 has been regularized as General Line Teacher, as such, this application has been moved by the petitioner for amendment of the writ petition for assailing the regularization of respondent No. 5 and for commanding the official respondents to select and engage the petitioner as Teacher w.e.f. 10.02.2014.
2. Despite service, respondent No. 5 has not chosen to appear. The official respondents too have not bothered to file response. In order to avoid the multiplicity of the litigations and to effectively determine the controversy at hand, this Court is of the considered view that the Serial No. 49

application deserves to be allowed. Accordingly the same is allowed. the amended writ petition is taken on record.

In view of the fact that the petitioner has sought relief for appointment as a Regular Teacher as mentioned in Para ‘d’ of the relief part of the writ petition, the instant writ petition is transferred to Central Administrative Tribunal (CAT), Jammu Bench. Registry shall transmit the record of the case to the CAT, Jammu Bench, which shall deal with the same in accordance with law after issuing notice to both the parties. Registry shall retain soft copy of the writ petition for the purpose of record.
