Records show that vide order dated November 20, 2024, the appellant was granted time to move an appropriate application to bring on record the legal representatives of respondent no.1-Naib Chand, who had passed away during the pendency of appeal 02. Concededly, no such application has been moved to date, rather learned counsel for the appellant submits that despite repeated communication(s)/reminders neither the appellant nor anyone on his behalf has contacted his office for the past couple of years. Accordingly, he submits that with the efflux of time, the appellant appears to have lost interest in the lis, therefore, the appeal be disposed of as having been rendered infructuous. However, in the event any dispute/interest/ cause of action still survives, he be granted liberty to move an appropriate application for revival of the appeal and its decision on merits. 03. Learned counsel for the respondents pleads no objection to the suggestion made by the learned counsel for the appellant. 04. Accordingly, the appeal is disposed of with liberty prayed for.
