01. Through the medium of the present petition, the petitioner is seeking implementation of order dated 10.12.2013 passed by the writ Court whereby respondents have been directed to consider the case of the petitioner for regularization of his services and also for release of wages on the touchstone of Minimum Wages Act.
02. Respondents have filed compliance report in which it has been submitted that the claim of the petitioner has been considered and rejected in terms of the order dated

27.12.2014. A copy of the said order has been produced by the respondents. In the said order, it has been observed that the petitioner is working as a part time Safaiwala and his job is just confined to morning hours and therefore, he is not entitled to minimum wages. Regarding the claim of the petitioner for regularization of his services, it has been observed that because of the nature of engagement of the petitioner, he does not qualify for regularization of his services.

Learned counsel for the petitioner has submitted that the
consideration order is not in accordance with law, as such, the compliance report deserves to be rejected.
04. The issue as to whether or not the consideration order is legally tenable cannot be gone into by this Court while exercising its contempt jurisdiction. The direction of the writ Court was only to consider the case of the petitioner which they have done and have rejected.
05. The legality of the order can be determined only if the petitioner chooses to assail the same by way of appropriate proceedings.

06. For the foregoing reasons, the contempt proceedings are closed leaving it open to the petitioner to challenge the
consideration order by way of appropriate proceedings.
07. The contempt petition is accordingly, disposed of.
