The appeal has been listed today under the caption ‘for dismissal’. Though the appeal is pending from the year 2014, the learned counsel for appellants, who are the unsuccessful plaintiffs in the suit, again seeks time to argue the matter. A perusal of the records would show that the matter had been adjourned, at the request of the appellants, without any further progress for almost 12 years. Even when the matter was listed on 16.03.2026 before us, this Court adjourned the case to 06.04.2026 making it clear that no further time would be granted. However, when the matter appeared on 06.04.2026, the learned counsel for appellants again took an adjournment. Therefore, the matter was directed to be listed on 20.04.2026 under the caption ‘for dismissal’. Even today, the learned counsel only seeks for an adjournment to argue the appeal. Hence this Court has no other option except to dismiss the appeal for non prosecution. Accordingly, the appeal stands dismissed for non prosecution. (P.VELMURUGAN J.)
