1. Today in Court, Mr. B.V. Niren, learned Standing Counsel for respondent-UOI has handed over a copy of Office Memorandum dated 10th June, 2014 issued by Ministry of Health and Family Welfare, Government of India, which is taken on record. The aforesaid Office Memorandum reads as under: “S 11011/15/2013-CGHS (P) Government of India Ministry of Health and Family Welfare CGHS (Policy) Nirman Bhawan, New Delhi Dated : the 10th June, 2014 OFFICE MEMORANDUM Sub: Extension of CGHS facilities to the retired employees of Statutory/Autonomous bodies, whose serving employees are already covered under CGHS-reg. The undersigned is directed to state that this Ministry has been receiving request from various Statutory/Autonomous bodies and their Employees/Pensioners Associations for extension of CGHS facilities to the retired employees of such Statutory/Autonomous bodies whose serving employees are already covered under CGHS. The matter has also been raised before different Courts of law. 2. The matter has been considered in the Ministry and it has been decided to extend the CGHS facilities to the retired employees also of such Statutory/Autonomous bodies whose serving employees are already covered under CGHS. 3. The CGHS facilities will be extended to the retired employees of such Statutory/Autonomous bodies subject to the following conditions. (a) CGHS facilities will be extended to the retired employees of the Statutory/Autonomous bodies on cost-to-cost basis. They will be entitled to OPD facilities and medicines from CGHS Wellness Centres in Delhi/NCR only. (b) Medical Expenses incurred on IPD/hospitalization treatment of the pensioner beneficiary and their eligible family members shall be borne by the statutory/autonomous bodies concerned as per CGHS approved rates and guidelines. (c) CGHS card(s) will be issued only on receipt of the recommendation of Statutory/Autonomous bodies concerned along with advance payment of requisite service charges at prescribed rate (on cost-to-cost basis) on annual basis. The CGHS cards will be renewed on annual basis on receipt of annual service charge in advance from the Statutory/Autonomous bodies concerned. 4. In this connection, it is to inform that the Statutory/Autonomous bodies which are already covered under CGHS for their serving employees and are desirous to extend CGHS facilities to their retired employees also, may accept the above conditions and forward their proposal, with the approval/recommendation of IFD through their Administrative Ministry/Department, to this Ministry for consideration. 5. Mr. Niren clarifies that the medical facilities that were being extended to the serving employees have been extended prospectively to the retired employees on the same terms. In view of the aforesaid, learned Counsel for petitioners are satisfied. Accordingly, present petitions and application are disposed of as satisfied.
