By way of the present petition, the petitioners seek quashing of FIR No. 421/2013 registered under Sections 420 and 34 of the Indian Penal Code, 1860, at Police Station Fateh Pur Beri, arising out of a dispute concerning certain immovable property, on the ground that the parties have amicably resolved their differences by executing a Memorandum of Understanding dated 16.10.2013 [“MoU”]. After some hearing, Mr. Rakesh Malviya, learned counsel for the petitioner, submits that during the pendency of the present petition, the charge-sheet has been filed, and the offences involved are compoundable. He, therefore, seeks permission to withdraw the present petition, with liberty to approach the learned Trial Court for compounding of the offences qua the present petitioners. 3. Mr. Prashant Sharma, learned counsel for the complainant, submits that the complainant has already made a statement before the learned Trial Court expressing no objection to the compounding of the offence against the present petitioners. 4. In view of the aforesaid submissions, the present petition, alongwith the pending applications, is dismissed as withdrawn, with liberty as aforesaid. 5. It is clarified that this Court has not expressed any opinion on the merits of the case and it shall be open to the learned Trial Court to consider and decide the application for compounding, if filed, in accordance with law.
