The present application has been filed praying for taking the Memorandum of Family Settlement dated 16.12.2025 on record and further seeking withdrawal of petition. 2. Mr. Amit Gupta, learned counsel appearing on behalf of respondent nos.2 to 5 submits that during the pendency of present petition, the parties have arrived at a settlement, terms whereof have been recorded in writing in the form of Memorandum of Family Settlement dated 16.12.2025. 3. The said settlement has been signed by the petitioner, as well as, respondent nos.2 and 5, whereas the other family members are witnesses to the said family settlement. It is further stated by Mr. Gupta that respondent no.6 has also relinquished her share in the property in question. Insofar as defendant no.4 is concerned, it is stated that she has passed away. 6. In view of the fact that the parties have arrived at a settlement and the petitioner is seeking withdrawal of present petition in view of the said family settlement, this Court does not find any impediment in allowing the present application. 7. Accordingly, the application is allowed. 8. The parties shall remain bound by the said Memorandum of Family Settlement dated 16.12.2025. 9. The application is disposed of. TEST.CAS. 97/2014 10. In view of the order passed above, the present petition is dismissed as withdrawn. 11. The next date already fixed before the learned Joint Registrar i.e. 31.07.2026 stands cancelled.
