1. The present petition has been instituted by the petitioners seeking a declaration that the land acquisition proceedings initiated pursuant to the Award dated 01.09.1993, in respect of the land of petitioner No.1 admeasuring 2.00 H.R., out of Survey No. 180, P.H. No. 63, Mouza Dudhala, Tahsil Katol, District Nagpur, be declared as having lapsed.
2. Respondent No. 3 has filed a reply contending, inter alia, that the petitioners have already submitted a representation under Section 48 of the Land Acquisition Act before the Hon’ble Revenue Minister, State of Maharashtra, and that the said proceedings are presently pending consideration.
3. Learned AGP was directed to obtain necessary instructions in that regard. On instructions, learned AGP submits that the representation filed by the
2 7-wp-193-2014.odt petitioners is pending consideration before the Hon’ble Revenue Minister.
4. In view of the aforesaid position, the petitioners are directed to appear before the Hon’ble Revenue Minister on 5th March, 2026. The Hon’ble Minister shall, after affording an opportunity of hearing to all concerned parties, decide Revenue Case No. xkoBk.k&4906@iz-dz-79@j&12, within a period of two months from 5th March, 2026.
5. The parties shall maintain status quo in respect of the subject land until the final decision is rendered by the Hon’ble Revenue Minister, Government of Maharashtra (Respondent No. 2).
6. In view of the above directions, the writ petition stands disposed of. No order as to costs.
