By way of filing the instant criminal misc. petition, a prayer has been made for issuing directions to the Investigating Agency to procure the call details of the occurrence, for which an FIR No.72/2014 registered with the Police Station Sadar Beawar, District Ajmer for the offence under Section 452/376 IPC. 2. At the outset, learned Public Prosecutor apprised this Court that in the aforesaid FIR, after submission of charge-sheet against the accused, the accused has already been acquitted by the Court of Additional Sessions Judge No.3, Beawar vide judgment dated 14.10.2014. He submits that under the changed circumstances, no cause of action survives with the petitioner to continue with this misc. petition and the same has become infructuous. (2 of 2) [CRLMP-2857/2014] 3. Considering the above factual aspect of the matter, the instant criminal misc. petition is dismissed as having become infructuous. Pending applications, if any, also stand dismissed. 5. The factual report submitted by the Station House Officer, Beawar Sadar, District Beawar is ordered to be retained on record.
