BEFORE THE NATIONAL LOK ADALAT National Insurance Co. Ltd. vs. Suman Devi & anr. FAO No. 169 of 2014 14.03.2026 Present: Mr. Pritam Singh Chandel, Advocate for the appellant alongwith Ms. Tanu Mohil, Deputy Manager and Ms. Sunita Verma, Assistant Manager, Legal Assistant for NIC. Mr. Rahul Kumar, Advocate vice counsel for the respondent No.1. Mr. Rakesh Thakur, Advocate for the respondent No.2. The matter has been referred for determination to the National Lok Adalat. Both the parties have voluntarily and amicably settled the matter with their free consent, will, volition and without any undue influence or misrepresentation. The parties have placed on record Ext. PA which is calculation made after settlement arrived at between the parties and taken on record. Ext. PA duly singed by the parties/counsels. As per Ext. PA final settlement amount comes to Rs.4,15,960/- (Four Lacs Fifteen Thousand Nine Hundred Sixty Only). The parties have also agreed that this amount of Rs.4,15,960/- (Four Lacs Fifteen Thousand, Nine Hundred Sixty Only) shall carry interest @ 12 % interest per annum w.e.f. 22.09.2008 as already awarded. Difference amount of Rs.3,11,970/- (Three Lacs Eleven Thousand Nine Hundred Seventy Only) be refunded to the appellant- Insurance Company alongwith proportionate interest. If any, amount is found due, in view of the compromise Ext. PA, the same also be refunded to the claimant. Accordingly, in view of the settlement arrived at between the parties, the order passed by ld. Commissioner Employee’s Compensation Solan, District Solan, H.P., passed in ECA No. 2/2 of 2021 titled Suman Devi vs. Geeta Ram & anr., dated 01.04.2013 stand modified. Thus, in view of the aforesaid terms and conditions of the settlement, the matter stands finally settled between the parties and nothing is due. The terms and conditions of the settlement as above have been explained to the parties/counsel in Hindi, which they have accepted as correct and appended their signatures in evidence of the settlement. Members have also counter signed it. File be sent to the Registry of the Hon’ble High Court for doing the needful/consignment. Copy of order be supplied to the parties free of costs.
