thereby determining the market value of the acquired land @ Rs.1,00,000/ per acre for nehri/ chahi besides award of all other statutory benefits and interests provided under the 1894 Act. 3. Dissatisfied with the Award passed by the LAC, reference petition under Section 18 of the 1894 Act was preferred at the instance of similarly situated landowners, which was partly allowed by the learned Reference Court vide its decision dated 3 value was re-assessed @ Rs.2,00,000/ Rs.1,25,000/- per acre for benefits/interest as provided under the 1894 Act. 4. Still aggrieved, the petitioners/landowners invoked Section 28 A(3) of the 1894 Act claiming that the LAC erred in awarding compensation by treating their land as The learned Reference Court vide order dated 06.03.20 said claim of the petitioners/landowners. Hence, the present revision petition. 6. I have heard learned counsel for the parties and gone through the paper-book as well as records of the case. (O&M) thereby determining the market value of the acquired land @ Rs.1,00,000/ nehri/ chahi land and Rs.65,000/ besides award of all other statutory benefits and interests provided under Dissatisfied with the Award passed by the LAC, reference petition under Section 18 of the 1894 Act was preferred at the instance of similarly situated landowners, which was partly allowed by the learned Reference Court vide its decision dated 30.01.2008 whereby, the market assessed @ Rs.2,00,000/- per acre for per acre for barani land besides all other statutory benefits/interest as provided under the 1894 Act. Based thereupon, the petitioners/landow application under Section 28A of the 1894 Act before the LAC whereupon, vide decision dated 30.01.2008, the petitioners/landowners were awarded compensation @Rs.1,25,000/- per acre holding their land to be of aggrieved, the petitioners/landowners invoked Section 28 A(3) of the 1894 Act claiming that the LAC erred in awarding compensation by treating their land as barani, whereas the same was of The learned Reference Court vide order dated 06.03.20 said claim of the petitioners/landowners. Hence, the present revision I have heard learned counsel for the parties and gone through book as well as records of the case. 2 thereby determining the market value of the acquired land @ Rs.1,00,000/ land and Rs.65,000/- per acre for barani land besides award of all other statutory benefits and interests provided under Dissatisfied with the Award passed by the LAC, reference petition under Section 18 of the 1894 Act was preferred at the instance of similarly situated landowners, which was partly allowed by the learned 0.01.2008 whereby, the market per acre for nehri land and land besides all other statutory benefits/interest as provided under the 1894 Act.
Based thereupon, the petitioners/landowners herein preferred application under Section 28A of the 1894 Act before the LAC whereupon, vide decision dated 30.01.2008, the petitioners/landowners were awarded per acre holding their land to be of barani aggrieved, the petitioners/landowners invoked Section 28 A(3) of the 1894 Act claiming that the LAC erred in awarding compensation , whereas the same was of chahi nature. The learned Reference Court vide order dated 06.03.2014 dismissed the said claim of the petitioners/landowners. Hence, the present revision I have heard learned counsel for the parties and gone through book as well as records of the case. 2 thereby determining the market value of the acquired land @ Rs.1,00,000/- land besides award of all other statutory benefits and interests provided under Dissatisfied with the Award passed by the LAC, reference petition under Section 18 of the 1894 Act was preferred at the instance of similarly situated landowners, which was partly allowed by the learned 0.01.2008 whereby, the market land and land besides all other statutory ners herein preferred application under Section 28A of the 1894 Act before the LAC whereupon, vide decision dated 30.01.2008, the petitioners/landowners were awarded barani aggrieved, the petitioners/landowners invoked Section 28- A(3) of the 1894 Act claiming that the LAC erred in awarding compensation nature. 14 dismissed the said claim of the petitioners/landowners. At the very outset, it may be noticed tha pertaining to the present acquisition stands re decision of even date rendered in and anr. vs. State of Haryana” entitled to award of irrespective of the nature of the land along with all statutory benefits as provided under the 1894 Act. 8. In view of the above, award dated 06.03.2014 aside and the petitioners herein are market value @ Rs.2,00,000/ provided under the 1894 Act. 9.
