For the reasons mentioned in the application, the same is allowed, subject to all just exceptions and the affidavit dated 11.01.2026 is taken on record. CR-3934-2014
On 08.01.2026, the following order was passed:-
“
Learned counsel for the petitioner submits that the petitioner does not intend to challenge the impugned orders on merits and shall vacate the demised premises within a period of three months from today provided the respondents-landlords waive off the outstanding amount as it is due today.
Learned counsel for the respondents submits that he has no objection to the said proposal.
List on 14.01.2026.
Requisite affidavits be filed on or before the said date.”

In compliance thereof, affidavit dated 12.01.2026 has been filed by the petitioner, paragraphs 4 and 5 of which read as under:-

4. That however, now the petitioner does not intend to pursue with the present Revision petition and challenge the impugned orders on merits and will vacate the premises within 3 months subject to the respondent-landlord waiving all outstanding amount. That submission in this regard was duly recorded vide order 08.01.2026 passed by this Hon’ble Court and the Ld. Counsel for the respondent-landlord had made a statement stating he has no objection to the said submission. HIMANSHU 2026.01.16 13:23 I attest to the accuracy and integrity of this document

5. That in view thereof, the deponent undertakes to vacate the said demised premises i.e. shop bearing MCK No. 29/18, Talai Bazar, Kaithal, within 3 months that is on or before 15.04.2026 and will handover the peaceful vacant possession thereof to the respondent-landlord subject to the respondent-landlord waiving all outstanding amount.

On behalf of the respondents, affidavit of Amish Goel @ Amish Goyal has been filed, paragraph 2 of which reads as under:-

2. That respondent has no objection to if petitioner vacates premises in question within a period of 3 months as undertaken by him before this Hon’ble Court vide order dated 08.01.2026. The respondent/landlord and her LR’s will not claim any outstanding amount from petitioner due till today.

Learned counsel for the respondent submits that the aforesaid affidavit has been filed on behalf of all the respondents.

The revision petition is accordingly disposed of in terms of the statements of the parties by way of affidavits dated 11.01.2026 & 12.01.2026 filed in the Court, which have been taken on record today. Pending application(s), if any, shall stand disposed of.
