JUSTICE RAJESH MAZUMDAR ORDER 03.02.2026 Heard Mr. K. Sarma, learned counsel appearing for the petitioner. Also heard Ms. R. Kakoti, learned counsel appearing for the respondent no. 3. The rest of the respondents are not represented by their counsel today in the Court. This Court has noticed that the petitioner’s Association, namely, Indian Oil Corporation Limited (IOCL), Bongaigaon Refinery (BGR) Township Maintenance Electrical Workers Association is a non-registered Association. The affidavit has been sworn by the President of the said Association. The learned counsel has referred to the Resolution dated 11.09.2012 taken in the General Meeting of the Association to impress upon this Court that the writ petition is maintainable despite the fact that the petitioner is an unregistered Association. It has also gone through the Vakalatnama, the same has been signed only by the so called President of the Association. This Court in view of the settled position of law that a writ petition of an unregistered Association cannot be entertained is unable to continue to entertain the writ petition. Accordingly, this writ petition is closed in the present form, granting liberty to the Members of the so called Association to approach appropriate forum in accordance with law with any grievances that they may have regarding their contention for being regularized into the services of the IOCL.
