2. This writ application has been filed with a prayer to quash the recommendation/decision in the meeting dated 02.04.2014 with regard to “barrier free markets” (Annexure- 2). 3. On 02.04.2014, meeting had been held under the Chairmanship of the Chief Secretary, Odisha to discuss on replication of the model Unified Market Platform implemented in Karnataka through Rashtriya e-Market Services Ltd. The following decision was taken in the meeting:-
“Concluding the discussion, the Chief Secretary advised for undertaking structural reforms in agricultural marketing to put in place an efficient market system in the State. A formal partnership in the shape of an MoU can be entered into with the ReMS for development of a SPV with equity participation of the State and the ReMS for replicating the Kamataka model of Unified Market Platform. For the purpose, a Committee may be constituted at the appropriate level to draw up a Road Map for brining about necessary reforms and constituting the SPV to achieve the desired result. The Chief Secretary desired to draw a time schedule for implementation and expected the SPV to be formed by end of May so that, trading
takes place for the Kharif 2014 for Maize crop in Nawarangpur district to start with.”
4. On 14.05.2014, notice had been issued in the matter, but no interim order had been passed. 5. No counter affidavit has yet been filed in this case. The matter had been adjourned on 19.02.2016 and 15.03.2016 and thereafter it was listed on 29.08.2026 when no counsel appeared on behalf of the Petitioner when the matter was called. But in the interest of justice, the matter had been adjourned to 31.08.2026 but could not be taken up on that date and had been listed today. 6. None appears for the Petitioner when the matter is called. 7. Mr. Amitabh Pradhan, learned Additional Standing Counsel submits that the parawise comments had been received in the year, 2014 but specific instructions are not available whether any follow-up action have been taken pursuant to the meeting dated 02.04.2014. 8.
It appears that a similar writ application i.e. W.P.(C) No. 5611 of 2012 had been filed in this Court where on 04.04.2012, the recommendation dated 29.02.2012 for
abolishing the RMC check gates had been stayed. Thereafter the petition had been dismissed and the interim order vacated, as this Court did not find that the Petitioner had any loco standi to maintain the petition,
9. In the present case, more than 14 years have elapsed since the meeting was held on 02.04.2014. 10. Since no counsel appears on behalf of the Petitioner and more than 12 years have elapsed since the recommendation by the State Level Advisory-cum-Monitoring Committee was made in the meeting on 02.04.2014, it can safely be presumed that this application has become infructuous. No useful purpose will therefore be served by keeping this writ petition pending. 11. In view of the facts of the case, it is not necessary to refer the matter for mediation. 12.
