Pursuant to order dated 19.02.2026, the soft copy of the order sheet in GR Case No.717 of 2013 has been received from the learned Civil Judge (Junior Division)-Cum-JMFC, Chandikhole. 2. Perusal of the order-sheet reveals that the Petitioner-Tapan Kumar Pradhan has been released on bail in 2013. Charge-sheet has been filed in the case on 24.09.2013. On 23.11.2013, it has been mentioned in the order-sheet that inadvertently the case record was not put up since 24.04.2014 and is directed to be listed on 25.04.2014. From this it is apparent that there is some mistake on the date of posting as well as in the order. The order passed on 23.11.2013 is extracted below. “Inadvertently, the case record was not put up since 24.04.14 and put up today. However Issue fresh summons. Put up on 25.4.14 for appearance.” 3. It is apparent that there is mistake in the order. On 08.01.2014 order of this Court staying further proceeding was received by the learned Magistrate. Thereafter, the matter has been posted on 15.07.2014 and on 15.08.2022, the said order was vacated and the case was posted to 20.03.2023 for appearance of the accused. On 20.03.2023, the matter has been posted to 24.08.2024. On 24.08.2024 the matter has been posted on 06.04.2025. On 06.04.2025, the matter was posted on 30.07.2025. On 30.07.2025 the matter was posted to 19.12.2025 and thereafter the matter has been posted to 19.12.2025, 07.03.2021, 15.08.2022, 20.03.2023, 24.08.2024, 06.04.2025, 30.07.2025 and 19.12.2025. So, it is apparent that while sending instructions dated 04.02.2026, the detail instructions were not sent by the learned JMFC for which the Court was with the impression that after 15.08.2022, the matter has been posted to 25.09.2026. 4. Since no counsel appears on behalf of the Petitioner on 03.02.2026, 19.02.2026 and there is no appearance on behalf of Petitioner today, the CRLMC is dismissed for non-prosecution.
