A permanent injunction restraining the defendants by themselves, its directors, heirs, legal representatives, successors-in-business, agents, stockists, distributors, assigns, C&F agents, representatives or any one claiming under them from manufacturing, selling, offering for sale, advertising, directly or indirectly dealing in the product Linezolid manufactured so as to result in infringement of the plaintiff s registered patent No. IN 213063 in any manner whatsoever; c. The defendants be ordered to surrender to the plaintiff for destruction to the plaintiff all materials and implements used for creation of the infringing goods to be forfeited or destroyed as the Court deems fit in the facts and circumstances of the case; d. a preliminary decree be passed in favour of the plaintiff directing the defendants to render account of profits directly or indirectly earned by the defendants from its infringing activities and wrongful conduct and a decree for the amount so found due to be passed in favour of the plaintiff; e. The defendants be directed to pay to the plaintiff, a sum of Rs.10,05,000/- as damages; and f. For costs of the suit.
