SRINIVAS BASAVA The Court made the following: ORDER: Petitioners are seeking a direction from this Court to the respondents to consider their cases for appointment in the vacant posts of Staff Assistants out of the vacancies notified in notification dated 04.09.2011. 2. The learned Standing Counsel for the 3rd respondent submits that the petitioners were unsuccessful candidates who applied for the said posts and the petitioners are now seeking appointment on regular basis in the vacant post which arose on account of a vacancy arising out of resignation of some of the employees. It is further submitted that the notification does not provide any provision for considering the unsuccessful candidates as candidates on waiting list for entitling them for the post of Staff Assistant. It is also submitted by the learned Standing Counsel that the petitioners would have to apply afresh subject to their entitlement. It is submitted that several petitioners had passed the age of eligibility criteria for applying for the said post and even sought for an exemption on account of their service on contract basis and the petitioners are working in societies unconnected with the 3rd respondent. 3. Recording the submissions, no further orders can be passed and the petitioners as a matter of right cannot seek for directions for employment against the vacant posts of Staff Assistants more so when the notification does not provide for considering the waiting list of candidates for appointment against any vacancy. 4. Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.
