The learned counsel for the petitioner submits that the petitioner was appointed as a driver on 22.02.1988 and rendered service for a period of 12 years, and that he was removed from service for having caused an accident resulting in the death of one passenger and injuries to 11 other passengers, including the service conductor. 2. The Enquiry Officer submitted a report holding the petitioner responsible for causing the accident and the disciplinary authority issued proceedings of removal dated 08.03.2000. The petitioner filed an appeal and review before the competent authorities, which were summarily rejected. Thereafter, the petitioner filed I.D. No.172 of 2007 before the Labour Court, Anantapur, and the Labour Court also rejected the claim of the petitioner. 3. It is submitted that the petitioner had attained the age of superannuation long back and is now confining his claim to the release of service benefits for the period of service rendered. 4.
The learned Standing Counsel appearing for the respondents submits that the petitioner cannot claim service benefits as he was removed from service and that the Labour Court also gave a finding that the petitioner caused the accident on account of rash and negligent driving. 4

Considering the submissions, this Writ Petition is disposed of, directing the 1st respondent to release the service benefits due and payable to the petitioner for the period from 22.02.1988 till the date of removal, i.e., 08.03.2000, if not already released by the respondents. 6. With the above observation, this Writ Petition stands disposed of. There shall be no order as to costs.
