Lutheran College of Education, Guntur, which is under the control of 4th respondent management basing on the proposals submitted by the 4th respondent to the 2nd respondent vide Letter Rc.No.Est/38A/04 dt.12.1.2005, as illegal, arbitrary, contrary to law and also violative of Articles 14, 16 and 21 of the Constitution of India and consequently direct the respondents to approve the promotion of the petitioner in the Aided post of Principal in Andhra Lutheran College of Education, Guntur by regularizing her service with effect from 1.9.2004 till her retirement i.e. on 28.2.2006 with all consequential benefits on par with Dr. J. Prasant Kumar, Principal, whose promotion was approved by the 1st respondent vide Govt. Memo No. 9907/Trg/A1/2007 dt:
1.5.2008 and pass. IA NO: 1 OF 2013(WPMP 44907 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the 2nd respondent to consider the proposals of promotion, in respect of the petitioner, submitted by the 4th respondent management vide Letter Rc.No.Est/ 38A/04 dt.12.1.2005, pending disposal of the writ petition and pass. THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NO: 36122 OF 2013 ORDER: The petitioner is seeking a direction from this Court to the respondents to approve the request of respondent No.4 for promoting the petitioner in the aided post of Principal of respondent No.4-Educational Institution. 2. The petitioner was aged about 65 years and retired as Principal at the time of filing the writ petition. Directions for promoting after retirement of an employee cannot be issued on these considerations. 3. Accordingly, no further orders are required to be passed and the Writ Petition is closed.
