HARI SREEDHAR The Court made the following: 2 THE HON’BLE SRI JUSTICE V.SRINIVAS APPEAL SUIT No.399 of 2013 JUDGMENT: This Appeal Suit is filed against the Judgment and Decree, dated 22.01.2013 passed in O.S.No.118 of 2008 on the file of the learned I Additional Senior Civil Judge, Rajahmundry. 2. Learned counsel for the respondent No.1 filed a memo along with a certified copy of joint memo obtained from the learned IV Additional Junior Civil Judge, Rajamahendravaram, stating that the 1st defendant vacated the plaint schedule building and delivered vacant possession to the plaintiff and the 1st defendant received compensation from the plaintiff, even to withdraw his claim for specific performance of agreement for sale, against the plaintiff, which claim is now pending before this Court in A.S.No.399 of 2013. It is further stated that the 2nd defendant in O.S.No.592 of 2014 was never in possession of the plaint schedule building and the appellant intend to not press the present appeal. 3. In view of the above, the Appeal Suit is dismissed as not pressed. There shall be no order as to costs.
