HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU OWP No. 201/2012 C/w WP (C) No. 116/2022 WP (C) No. 488/2022 Khushi Ram and others .....Appellant(s)/Petitioner(s) Through :- Mr. P N Raina, Sr. Advocate with Mr. J A Hamal, Advocate v/s State of J&K and others .....Respondent(s) Through :- Mrs. Monika Kohli, Sr. AAG with Ms. Nisha Kangotra, Assisting counsel Mr. Ashish Singh Kotwal, Advocate CORAM: HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDER 19.08.2026 1. After hearing learned counsel for both sides, it is apparent that initially the petitioners had laid motion by way of OWP No. 201/2012, challenging the land acquisition proceedings initiated by the respondents in terms of Section 4 of the J&K State Land Acquisition Act, whereas during the currency of those proceedings, a final award came to be drawn, that has been separately assailed by the petitioners in WP (C) No. 116/2022. 2. It is argued by learned counsel for the respondents that the first petition has been rendered infructuous because of the subsequent developments. 3. Per contra, learned Senior counsel appearing for the petitioners submits that, while challenging the initial notification, Sr. No. 251 2 OWP No. 201/2012 C/w WP (C) No. 116/2022 WP (C) No. 488/2022 the petitioners had also raised questions regarding the conduct of revenue officers. 4. Be that as it may, since the original proceedings in terms of Section 4 of the J&K State Land Acquisition Act stand merged with the final award, which has been questioned in WP(C) No. 116/2022, the petitioners shall have all liberty to raise all the pleas available to them while advancing arguments in support of WP(C) No. 116/2022. 5. In that background, OWP No. 201/2012 has been rendered infructuous and is, accordingly, dismissed. The other two petitions viz. WP(C) No. 116/2022 and WP(C) No. 488/2022 be listed for continuation on 29.08.2026, with liberty to make mention. (Sanjay Parihar) Judge JAMMU 19.08.2026 Diksha
