1. This application has been moved by the applicant, namely, Charanjit Ek Nath Londhe, wife of the deceased petitioner seeking condonation of delay in filing an application, for bringing her on record, as legal representatives of the deceased petitioner on the ground that she was not aware about the pendency of this petition filed by her husband who had expired on 13.05.2013 and on coming to know about the pendency of this petition after the death of the husband, she came from Srinagar to Jammu and filed the instant application. 2. The respondents have filed objections to the application stating therein that since no application for bringing on record the legal heirs of deceased petitioner and substitution in his place was filed after the death of petitioner, the respondents filed an application CMA no. 3630/2013 on 13.11.2013 for dismissal of the writ petition having been abated that thereafter the petitioner has moved this application which cannot be allowed, being inordinately delayed and prayed that petition is liable to be dismissed as having been abated. Having heard from both sides and having regard to the period of limitation for filing of application to bring on record the legal heirs being six months in that precise of time, the petition moved after more than 07 months resulting into the delay in filing more than two months. In the interest of justice, this delay is not inordinate and is liable to the condoned. 4. The application is, thus, allowed and delay in filing the application for bringing on record the legal heirs of the deceased petition is condoned. CM No. 250/2014
5. This application has been moved by the applicant, namely, Charanjit Ek Nath Londhe, wife of the deceased petitioner with a prayer to bring on record as legal representative of deceased petitioner. Objections have been filed. 6. Heard and considered. 7. For the reason assigned in the application and submissions from both the sides, in the interest of justice and particularly in the face of condonation of delay, this application is allowed and the applicant, namely, Charanjit Ek Nath Londhe, is ordered to be brought on record as legal heir of the petitioner. 8. The application is, thus, disposed of. SWP No. 2556/2012
9. The respondents are granted last and final opportunity to file reply/ objections within a period of four weeks.
