This matter is taken up through hybrid mode. 2. Heard learned counsel appearing for the Parties. 3. In course of hearing learned counsel appearing for the Petitioner contended that since order passed by the disciplinary authority under Annexure-4 is under challenge, Petitioner be permitted to withdraw the writ petition with liberty to move the appellate authority. However, it is contended that since the writ petition is pending from the year 2012, delay in filing the appeal be condoned. 4. Learned CGC has no serious objection to the course of action proposed by the learned counsel appearing for the Petitioner. 5. Having heard learned counsel appearing for the Parties and considering the submission made, this Court while disposing the writ petition, permits the Petitioner to move the appellate authority against the impugned order dtd.09.07.2008 under Annexure-4. Page 2 of 2. 5.1. It is observed that, if any such appeal will be filed within a period of six (6) weeks hence, the appellate authority shall entertain the appeal and decide the issue on merit without insisting on any delay. 6.
