Heard learned counsel appearing for the Parties. 3. Mr. J.K. Rath, learned Senior Counsel appearing for the Petitioner contended that the proceeding was initiated against the Petitioner vide Memorandum dtd.06.05.2009 under Annexure-8 and subsequently additional charges were framed against the Petitioner in the self-same proceeding on 28.04.2010 under Annexure-15 and 13.12.2010 under Annexure-26. However the proceeding originally initiated on 06.05.2009 was disposed of vide order dtd.05.04.2013 of the disciplinary authority, who happens to be the Chairman-cum-Managing Director of the federation. Copy of the order so produced in Court be kept in record. Copy of the order is also provided to Mr. Kanungo, learned counsel in Court. 4. Learned counsel appearing for the Federation is directed to obtain instruction as to whether after disposal of the proceeding initiated on 06.05.2009 vide order dtd.05.04.2013, the Departmental Proceeding can proceed with regard to the additional charges framed in the said proceeding. 5.
