1. The application has been presented before this Court on 25.01.2012. On 24.02.2012 notices were issued by the coordinate Bench. Thereafter the matter has not been prosecuted by the petitioner. Today when the matter is taken up, none appears for the opposite party though the learned counsel is on record.
2. It is submitted on behalf of learned counsel for the petitioner that they do not have any instruction in the matter.
Accordingly, the learned counsel for the petitioner is asked to file memo indicating the statement made at the bar. Memo is filed which shall be kept on record. Scanned copy be updated. Memo states thus :
“In the above case we have no instruction from the petitioner since long. And today on 18.02.2026, this case is listed in item no.1 for admission/hearing. On call of the case by the Hon’ble Court we ordered to file a memo regarding the no instruction from the party.”(sic)
2. The petitioner-husband in the marriage by filing the petition has challenged the order dated 3.12.2011 passed in I.A. No. 52 of 2010 as arising out of CP No. 333 of 2010. The said I.A. was filed in the CP then pending before learned Judge, Family Court, Balasore under section 24 of Hindu Marriage Act seeking maintenance pendente lite. The CP was filed by the husband under section 13 of the Hindu Marriage Act.
3. In view of the memo filed and in the above facts and circumstances, the petition stands disposed of.
