The Branch Manager is requested to be present before the Court to assist in the proceedings, inasmuch as the Petitioner has handed over the peaceable possession of security property yesterday to the Bank. To that effect, Petitioner has filed affidavit dated 29.01.2026, which reads as under:
“ AFFIDAVIT ON BEHALF OF THE PETITIONER
I, Minati Sahu, aged about 64 years, W/O-Choudhury Niranjan Mohapatra, At-Flat No.E-103, Ashraya Apartment, Professor Para, Cuttack-753012 do hereby solemnly affirm and state as follows:
1. That I am the petitioner in this Writ Petition.
2. That it is humbly submitted that the petitioner has already handed over the possession of the flat which is the subject matter of this writ petition(E-103 Ashraya Apartment, Professor Para, Cuttack-753012) to the bank today (28.01.2026) in the evening.
3. That the facts stated above are true to the best of my knowledge and belief.”(sic)
2. W.P.(C) No.3607 of 2025, in view of this development, has been rendered infructuous and accordingly is disposed off.
