The writ petition has been filed against the order passed by the Arbitrator under Section 3G(5) of the National Highways Act, 1956 (for short “the Act of 1956”). As per Section 3G(6) of the Act of 1956, the provisions of Arbitration and Conciliation Act, 1996 (in short “the Act of 1996”) apply and, accordingly, if petitioner was aggrieved by the award passed by the Arbitrator, he could have maintained objection under Section 34 of the Act of 1996 but for that, writ petition would not be maintainable.
