1. Appellant – Rajesh Arora, then aged 39 years, filed present appeal challenging the judgment of conviction and order of sentence dated 23.12.2011, passed by Ld. Judge, Special Court, Amritsar, in Corruption Case No.26 of 15.9.2003/7.9.2011 RBT, arising out of FIR No.33, dated 17.06.2003, under Sections 420, 467, 468, 471, 120-B of IPC and 13(1)(d) r/w 13(2) of Prevention of Corruption Act, registered at Police Station Vigilance Bureau, Amritsar.
2. Accused-appellant was held guilty for commission of offence punishable under Sections 120-B, 420, 468, 471 of IPC, and was sentenced for a period of 03 years Rigorous Imprisonment (RI) and to pay a fine of Rs.3,000/- each for all above offences, and in default of payment of fine, further S.I. for three months (in all offences).
3. Today, there is no representation on behalf of the appellant. However, learned State counsel, on instructions, has submitted that appellant – Rajesh Arora has already expired during the pendency of present appeal JAWALA RAM 2026.08.11 20:20 I attest to the accuracy and integrity of this document
CRA-S-170-SB-2012 (O&M) - 2 - and produced copy of death certificate dated 01.10.2025, issued by the Office of Sub Registrar, Central Zone (MC Amritsar). As per said death certificate, appellant expired on 19.09.2025. Photocopy of said death certificate is taken on record, subject to all just exceptions. Office to tag the same at appropriate place.
4. Therefore, in view of the above noted circumstances, present appeal stands abated, and same is disposed of as such. However, it would be subject to the terms & conditions, passed by this Court in Shivji Ram @ Dimple Vs. State of Punjab, 2022 SCC Online P&H 3759 (Law Finder Doc Id # 2076392).
5. Appeal stands disposed of. Pending misc. application(s), if any, also stand(s) disposed of.
