Ashwani Malik Vs. state State of H.P. Cr. Appeal No. 94 of 2012 22.5.2026 Present: Ms. Kiran Dhiman, Advocate, Legal Aid Counsel, for the appellant. Mr. Jitender Sharma, Additional Advocate General for the respondent/State. The present application has been filed for furnishing fresh surety bonds because the earlier surety bonds furnished by him were forfeited to the State of H.P. It appears from the record that a production notice was issued to the surety for producing the accused before the Court on 14.5.2025. Adjournments were sought by the surety for producing the accused, however, the surety failed to produce the accused before the Court; consequently, the surety bonds were forfeited on 03.09.2025. Therefore, the Court issued non-bailable warrants of arrest and the petitioner was taken in custody. He was brought before the Court on 16.4.2026 but he did not furnish any surety. Hence, he was ordered to be sent to jail till he furnishes fresh surety bond. Since the applicant/appellant is now ready to furnish the fresh surety bond, therefore, the present application is allowed and the petitioner is permitted to furnish surety bond in the sum of ₹40,000/- to the satisfaction of learned Registrar (Judicial) within a week. The applicant/appellant be released from custody after furnishing the requisite surety bonds. Present application stands disposed of. (Rakesh Kainthla) Judge 22nd May, 2026 (Chander)
