While the matter was being heard, it has come to the fore that the petitioner was not figuring in the select panel, which could have given a justifiable cause to the petitioner to pursue the instant matter on the strength of the judgment passed by the Hon’ble Apex Court in the case titled “UT of J&K & Ors. Vs Saba Wani” decided on 30.04.2026. Therefore, the case of the petitioner is not covered by the aforesaid judgment, particularly in view of paragraph 25(a) thereof, which for facility of reference is reproduced as under:- “The Closure Order of ReT Scheme dated 16.11.2018 for cancellation/withdrawal shall not retrospectively impair the right of the candidates found placed in the select panel. In view of the discussion made hereinabove, the candidates placed in respective select panels shall be issued engagement/appointment Sr. No. 173 2 SWP No. 2483/2011 orders as per their position in the select panel having regard to the available vacancies.” 2. Mr. Z A Mughal, learned counsel for the petitioner fairly concedes to the aforesaid legal position and seeks withdrawal of the instant petition. 3.
