1. This matter has been listed under the heading “For Referral To The Special Mediation Drive- Mediation ‘For The Nation’ ”.
2. As no counsel appeared on behalf of the Parties the matter was passed over in the first hour.
3. When the matter is taken up after recess no counsel appears on behalf of the Petitioners, Opposite Party No. 1 or Opposite Parties No.2 and 3, although counsels have been engaged by the Petitioners as well as the Opposite Party No. 1 and Opposite Parties No.2, and 3.
4. This writ petition has been filed challenging the order dated 15.10.2011 passed in Civil Suit No. 494 of 2007, where petition filed by the Defendants No.2 and 3 for staying the suit till disposal of FAO No. 72 of 2011, has been allowed.
5. On 29.11.2011, notice has been issued to the Opposite Parties No.2 and 3 by normal process and Opposite Party No.1 by special messenger, fixing the next date to 07.12.2011.
6. But the matter was not been listed on 29.11.2011 and has been listed today. Almost 15 years have elapsed since the impugned order was passed.
7. As no counsel is appearing on behalf of the Parties it can safely be presumed that in the meanwhile, either Civil Suit No. 494 of 2007 or FAO No. 72 of 2011 have been disposed of.
8. Hence no useful purpose will be served by keeping this writ petition pending.
9. The writ petition is accordingly dismissed.
