09. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel for the Petitioners and
learned counsel for the Opposite Parties.
3. The Petitioners have filed the present Writ Petition
with the following prayer:-
“The petitioners therefore most humbly pray that this Hon'ble Court be graciously pleased, to issue rule Nisi calling upon the opposite parties to show cause as to why the temple police (Barakandas) shall not be extended the rationalization and equalization of their scale with effect from the date other category of employees extended i.e. from 1.1.1986 with all consequential arrears and pay revision and as to why the order restricting the pay revision with effect from 1.1.08 shall not be held not sustainable in the eye of law and as to why it shall not be held that the temple police are entitled to the benefit with effect from 1.1.1986 with all consequential benefits.
And if the opposite parties fail to show cause or show insufficient cause to make the said rule absolute by issuing an appropriate writ(s),
order(s), direction(s) as deem fit and proper;
And/ or to pass such other order/orders, direction/directions as this Hon'ble Court deems just equitable and proper having regard to the
facts and circumstances of the present case.
And for this act of kindness the petitioners shall as in duty bound ever pray”.
4. Considering the submission made and without expressing any opinion on the merits of the case, Petitioners are
directed to make individual fresh representation before the Opposite Party No.2 by enclosing all the relevant documents and citations in support of their claim, if any, within a period of three (3) weeks hence.
5. It is observed that if such individual representation is filed within the aforesaid period, Opposite Party No.2 shall do well to dispose of the representation within a period of three (3) months from the date of receipt of such representations. The decision so taken by the Opposite Party No.2 be communicated to the Petitioners within that time.
6. It is observed that if as contended claim of the Petitioner is covered by an order passed by this Court in OJC No.7701 of 1999, disposed of on 25.01.2008, relevancy and effect of the said judgment be taken into
consideration. Petitioners are permitted to provide a copy of the judgment passed in OJC No.7701 of 1999 before Opposite Party No.2 for compliance.
7. With the aforesaid observations and directions, the Writ Petition stands disposed of.
