The amended cause title appended with the application is also taken on record. 3. Accordingly, the application (IA No.1/2026) is disposed of. (2 of 3) [CSA-93/2011] In IA No.1/2025: 1. Matter has come up on an application (IA No.1/2025) for deciding the instant second appeal in light of an amicable settlement arrived at between the parties. 2. Learned counsel for the appellant submits that during the pendency of the present second appeal, the plaintiff/appellant and the respondents have arrived at an amicable settlement to the present dispute vide compromise deed dated 31.03.2021 as well as the letter dated 21.10.2024. 3. In the compromise dated 31.03.2021, the parties to the dispute have resolved as under: " म  मुरारी लाल पु ी ठाु र दास ौम खी ० सीरी तह० सीरी ० भरतपुर (राज०) ा वासी ँ जो  अपठत ए दुा वाे मै बाजार !ा सीरी म" #$त है जसे तरफ द&ण हसैपुर दो मोटा पूराी साख हर #$त है मेरा उ+ दुा े संबंध म" संचाई वभाग से मुदमा/ अपील सं. 93/20 माीय राज० हाईोट2 म" चल रहा है जसम" हाईोट2 से 3े है। अब मैे सफाई 5व$ा व !े े हत म" 6े7ा व सहमत से द&ण ी जगह से खाली र शेष भूम पर मा2ण ाय2 र लया है अब हमारा व संचाई वभाग से ोई ववाद बाया हीं रहा है और म संचाई वभाग इस <रण सं. 93/2011 ो आगे हीं चलाऐग" और लो अदालत म" वापस ले लेगे। अब शेष बची दुा व उी जगह म" संचाई वभाग ा ोई संबंध हीं रहेगा। और संचाई वभाग आगे इस दुा े संबंध म" ोई ाय2वाही हीं रेगा। $ा- सीरी द 31.03.2021" 4. In the letter dated 21.10.2024, the parties to the dispute have resolved as under: " वादी ?ारा सीरी @ाम म" Aसैपुर दोमोरा ( पुराी सांख) हर ी पटरी पर आवागम व हर ी सफाई एवं संचाल हेतु @ाम हत म" 6े7ा से दुाों े द&ण दशा म" जमी ो खाली र दया है। जमी खाली रे े बाद अब ोई ववाद हीं है।" 5. He therefore, submits that the present appellant wishes to withdraw the present second appeal in terms of compromise deed dated 31.03.2021 annexed with the application as Annexure A-2 as well as the letter dated 21.10.2024 annexed with the application as Annexure A-1. 6. Heard. 7. In view of the above, the application (IA No.1/2025) is allowed. The present second appeal is dismissed as withdrawn in (3 of 3) [CSA-93/2011] terms of the compromise arrived at between the parties dated 31.03.2021 as well as the letter dated 21.10.2024. 8.
