Learned arguing counsel submits that the Disciplinary Authority in the departmental proceedings awarded the punishment of stoppage of one annual increment with cumulative effect to the petitioner, which was reviewed by the Inspector General of Police by dismissing him from service for remaining absent for 58 days, which was due to his involvement in a criminal case, from which he was acquitted vide judgment dated 16.09.2015. The appeal filed against the said order was also ordered to be filed without taking into consideration his past service record and punishment was thus disproportionate. He prays for reconsideration of the matter in light of the aforesaid as also the judgments of ‘Sultan Singh and Others Versus State of Haryana and Others’, CWP-542 of 2006 decided on 27.01.2026 and ‘Sunita Devi Versus State of Haryana and Others’, CWP-6558 of 2022 decided on 27.02.2026 by a Coordinate Bench. The above facts having been brought out, during the course of hearing, learned State Counsel fairly states that the Appellate Authority would not be averse to having a relook at the matter. 3. In view of the candid stand taken on either side, the present petition is disposed of while setting the order dated 15.02.0211, Annexure P- 18 dismissing the appeal and by remanding it to the Appellate Authority for reconsideration with regard to the punishment awarded, keeping in mind the submissions recorded hereinabove and the judgments referred to above and decide the same expeditiously in accordance with law after affording a proper opportunity of hearing to him, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner.
