Prayer made in the present petition for quashing the promotion of respondent Nos.3 to 5 to the post of Officer Scale-I might not be surviving due to efflux of time especially in wake of there being no interim order. 2. The learned Senior Counsel while referring to the written statement submits that the promotion order has not been appended alongwith the present writ petition. Be that as it may, the petitioner participated in the selection process but could not be promoted because the criterion was seniority-cum-merit and he was much down below in seniority with a number of his seniors above him, who were promoted. He relies on the judgment dated 27.11.2007 passed by a Coordinate Bench in CWP No.10044 of 2003 titled as ‘Gireesh Kumar and Others Versus Government of India and Others’, with regard to the previous promotions being based on the same criteria, wherein this very issue stands decided against the petitioner.
