Learned counsel for the respondents refers to paragraph No.4 of the written statement wherein it has been mentioned that the petitioner was granted the revised grade pay w.e.f. 01.10.2009, which was equivalent to his entitlement under ACP Rules and thus was not granted the ACP having already received two pay revisions. He having already availed two financial upgradations from his initial appointment was not eligible for grant of second ACP as on 26.10.2009 as per Rules.
