Learned State counsel however, refers to the written statement to submit that it is a case where Satpal was promoted to the post of Junior Engineer/Test on 13.03.1990 while petitioner could not at that time as he was not having the qualification of merit which he acquired w.e.f. 08.10.1997 and accordingly, came to be promoted, thus, is not a case of stepping up as has been projected. 3. Disposed of, reserving the petitioner with a liberty to get it revived by demonstrating that cause still subsists.
